Welcome to Tembii! These Legal Terms constitute a legally binding agreement between you and Tembii ("Company," "we," "us," or "our") concerning your access to and use of the Tembii mobile application and related services.

By accessing our services, you agree to these terms. If you do not agree, please discontinue use immediately.

1. Eligibility & Agreement

  • Age Requirement: You must be at least 13 years old to use Tembii. If you are under 18, you must have permission from, and be supervised by, a parent or guardian.

  • Updates to Terms: We may modify these terms from time to time. We will notify you of major changes via email or an in-app notice. Continued use of the app means you accept the updated terms.

2. Your Account & Responsibilities

To keep Tembii safe and functioning properly, you agree to the following when using our app:

  • Account Accuracy: You must provide true, accurate, and current information when registering, and keep your password secure.

  • Lawful Use: You agree not to use the app for any illegal or unauthorized purposes.

  • Prohibited Activities: You agree not to:

    • Scrape, data-mine, or automatically extract content from the app.

    • Interfere with security features, bypass access controls, or upload viruses/malware.

    • Harass, intimidate, or harm other users or our staff.

    • Impersonate others, sell your profile, or use the app to compete with us.

    • Reverse-engineer or adapt the app's software.

3. Intellectual Property & App License

  • Our Content: We own or license all intellectual property in the app, including code, designs, audio, video, and trademarks. We grant you a limited, non-exclusive, non-transferable license to access the app for personal, non-commercial use.

  • App Stores: If you download Tembii from the Apple App Store or Google Play, your use is also subject to their respective terms. We, not the App Distributors, are responsible for app support.

  • Your Feedback: If you send us suggestions, feedback, or ideas, you agree that we own those submissions and can use them for any purpose without compensation to you.

4. Third-Party Content & Ads

  • External Links: Tembii may contain links to third-party websites or content. We do not monitor or endorse these external sites and are not responsible for their accuracy, privacy practices, or any purchases you make through them.

  • Advertisers: We may provide space for advertisers on the app. Tembii simply provides the space and has no other relationship with the advertisers.

5. App Management & Termination

  • Our Rights: We reserve the right to monitor the app for violations, remove excessive or burdensome content, and take legal action if necessary to protect our platform.

  • Modifications & Interruptions: We do not guarantee the app will be available at all times. We may experience hardware or software issues, and we can change, suspend, or discontinue the app at any time without liability.

  • Termination: We reserve the right to suspend or terminate your account and block your access at any time, for any reason, without notice. If banned, you may not create a new account under a different name.

6. Disclaimers & Limitation of Liability

  • "As-Is" Basis: Tembii is provided on an "AS-IS" and "AS-AVAILABLE" basis. We disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee the app will be error-free or completely secure.

  • Liability: To the fullest extent permitted by law, Tembii, its directors, and employees will not be liable for any direct, indirect, consequential, or punitive damages (including lost data or profit) arising from your use of the app.

  • Indemnification: You agree to defend and hold us harmless from any claims, damages, or legal fees made by a third party due to your breach of these terms or violation of any laws.

  • User Data: While we perform routine backups, you are solely responsible for the data you transmit. We are not liable for any data loss or corruption.

7. Governing Law & Dispute Resolution

  • Governing Law: These terms are governed by the laws of Australia.

  • Dispute Resolution: If a dispute arises, we ask that you first attempt to resolve it with us informally for 30 days. If unresolved, the dispute will be settled by binding arbitration in Sydney, Australia, under the United Nations Commission on International Trade Law Arbitration Rules.

  • Class Action Waiver: Arbitrations will be conducted on an individual basis; class actions are not permitted.
